These terms govern your use of StayBuilt. They're written to be readable. Please read the medical disclaimer below carefully — it's the most important part.
These Terms of Use (the "Terms") apply to the StayBuilt website (the "Site") and the StayBuilt iOS application (the "App"), both operated by Bwino Works ("we", "us", "our"). By using the Site or the App, you agree to these Terms. If you don't agree, please don't use the service.
I.Medical disclaimer
Consult your healthcare provider before starting StayBuilt or any exercise program, especially if you take prescription medication (including GLP-1 receptor agonists such as Ozempic, Wegovy, Zepbound, or Mounjaro), have any medical condition, are pregnant, or are recovering from injury or surgery. Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any concerning symptom.
Bwino Works is not a healthcare provider. Use of StayBuilt does not establish any doctor-patient or healthcare relationship.
II.Eligibility
You must be at least 18 years old to use StayBuilt. By using the service, you confirm that you are 18 or older and capable of forming a binding contract.
III.About the service
StayBuilt is a timer-based functional strength and mobility iOS app designed for adults 35-65, with optional features for tracking GLP-1 medications and protein intake. The Site is a marketing page describing the App.
We may add, change, or remove features at any time. We may discontinue the service entirely with reasonable notice.
IV.Subscriptions and billing
StayBuilt offers Monthly and Annual auto-renewing subscriptions, billed through Apple's App Store. Subscription terms:
- Free trial — new subscribers receive a 7-day free trial. Cancel before the trial ends to avoid being charged.
- Auto-renewal — subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before renewal.
- Cancellation — manage or cancel your subscription anytime from iPhone Settings → your Apple ID → Subscriptions.
- Refunds — refunds are handled by Apple under their refund policy. Bwino Works cannot directly issue refunds for App Store purchases.
- Price changes — we may change subscription prices with at least 30 days' notice. You can cancel before any price change takes effect.
V.Your account and conduct
If you create an account, you are responsible for maintaining its security and for all activity under it. You agree not to:
- Use the service for any unlawful purpose.
- Attempt to reverse engineer, decompile, or extract source code from the App.
- Scrape, copy, or republish substantial portions of our content without permission.
- Resell, sublicense, or commercially exploit the service without written agreement.
- Interfere with or disrupt the service, including its servers and networks.
- Impersonate another person or misrepresent your affiliation with us.
VI.Intellectual property
The StayBuilt name, logo, app design, exercise illustrations, written content, audio, video, software, and all other materials we provide are owned by Bwino Works or our licensors and are protected by copyright, trademark, and other laws.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App and Site for personal, non-commercial purposes, subject to these Terms. You retain ownership of any data you provide to the service (your assessment results, workout logs, personal information).
VII.Third-party services
StayBuilt may interoperate with third-party services such as Apple HealthKit and the App Store. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the practices of third-party services.
VIII.Disclaimers
STAYBUILT IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the service will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected. We do not warrant any specific health, fitness, weight, or strength outcomes from your use of the service. Individual results vary.
IX.Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BWINO WORKS, ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Our total liability for all claims relating to the service in any 12-month period will not exceed the amount you paid us during that period (or USD $100, whichever is greater).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
X.Indemnification
You agree to indemnify and hold Bwino Works harmless from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the service, your violation of these Terms, or your violation of any rights of another person.
XI.Termination
You may stop using StayBuilt at any time by deleting the App and cancelling any active subscription. We may suspend or terminate your access to the service if you violate these Terms or for any other reason on reasonable notice.
Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply.
XII.Governing law
These Terms are governed by the laws of the State of Ontario, Canada, without regard to its conflict-of-law principles. Any dispute arising under these Terms will be resolved exclusively in the courts located in Toronto, Ontario, except that you may bring small-claims actions in your home jurisdiction.
XIII.Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top and, where appropriate, notify you in the App or by email. Your continued use of StayBuilt after changes constitutes acceptance of the updated Terms.
